§ 90.02. POWERS OF POLICE DEPARTMENT.

  • (A) The Town Marshal, or his or her deputy or designee, shall be empowered to designate as an abandoned vehicle any vehicle as defined as an “abandoned vehicle” under I.C. 9-13-2-1.
    (B) An officer of the Police Department who finds a vehicle or parts believed to be abandoned shall attach in a prominent place a notice tag containing the information that the vehicle or parts shall be removed after 72 hours and any other information as required by I.C. 9-22-1-11.
    (C) If the vehicle or parts are not removed within 72 hours, the officer of the Police Department is empowered to remove or cause to be removed the vehicle or parts to its designated impound area. The vehicle or parts shall be held for a minimum of 15 days or such time as is necessary for the search and notification provisions of I.C. 9-22-1-20 to be observed. At the conclusion of such time, the officer shall dispose of the vehicle or parts as provided by law and in a manner deemed appropriate by the officer.
    (D) If, in the opinion of the officer, the market value of the vehicle or parts shall be less than $100, the officer shall dispose of the vehicle or parts as provided by law and in a manner deemed appropriate by the officer.
